The use of expert witnesses to consult and testify regarding the adequacy of employment policies and practices, training, investigations, and corrective action in employment practices lawsuits and arbitrations is a growing trend across the country. The Supreme Court’s decision in Daubert v. Merrell Dow Pharmaceuticals, Inc., 509 U.S. 579 (1993), and Federal Rule of Evidence 702 allow expert opinion testimony as long as it "will assist the trier of fact to understand the evidence or to determine a fact in issue . . . ."
