California Training Requirements

California is specific regarding the content of the interactive sexual harassment prevention program that must be undertaken. EPS courses and instructors comply with these requirements and include the following:

  • Definitions and practical guidance regarding the federal and state statutory provisions concerning the prohibition against sexual harassment, including the prevention and correction of sexual harassment, and the remedies available to victims of sexual harassment in employment;
  • practical examples aimed at instructing all employees in the prevention of harassment, discrimination, and retaliation, presented by trainers or educators with knowledge and expertise in the prevention of harassment, discrimination, and retaliation;
  • guidance on the impact of abusive conduct in the workplace, including its legal definition and examples of abusive conduct;
  • specific instruction regarding harassment based on gender identity, gender expression, and sexual orientation including practical examples and presented by trainers or educators with knowledge and expertise in those areas.
