The ADA Amendments Act (ADA-AA) of 2008 was signed into law on Friday, September 26th, and will become effective January 1, 2009. The law effects significant changes in the way the ADA is applied, including eliminating the requirement that mitigating measures be considered when evaluating whether an individual has a disability, defining “major life activity” to include “operation of a major bodily function” (e.g., neurological, circulatory, and reproductive systems), and providing that an impairment that is episodic or in remission is a disability if it substantially limits a major life activity when active.
